(12PressRelease.com) For Immediate Distribution Date: June 8, 2011 SUBJECT - Two Counts of DWI - Not guilty verdicts Jill H. was charged with two counts of driving under the influence (DUI) in Exeter District Court in New Hampshire. The police officer alleged the driver was swerving all over the road. He then stopped her and had her do field sobriety tests which he claimed she failed. The driver was then transported to the police station where she gave a breath test which came back over the legal limit. At trial, defense counsel, Attorney Daniel Hynes, The N.H. DWI GUY (http://www.nhdwiguy.com) questioned the officer on what he remembered. At a point in the cross-examination, the dwi guy asked the officer what was written on his hand. The officer replied that he made a note of how the client failed the tests. The DWI GUY argued the officer did not actually remember what happened, and therefore his testimony should be stricken from the record. The State objected. The Judge took the matter under advisement, and eventually agreed that the officer did not remember what happened. Both misdemeanor charges of DWI were dismissed.
