(12PressRelease.com) A Chinese delivery man was struck by a car while making a delivery. He sustained fractures in his hands and legs. After the accident his attorneys filed a lawsuit against the car rental company. According to the victim‘s attorney, the insurance company revised their regulations, so now they are only obligated to pay victims a maximum of $25,000 for damages.
Five years ago, Mr. Jiang, a Chinese delivery man, was making a delivery in Brooklyn when he was struck by a car. He fractured his hands and legs and injured his cervical spine and head. He was hospitalized for two weeks.
Mr. Jiang: (Pointing out to the reporter where the injury on his hand was.)
Reporter: “Was there a fracture?â€
Mr. Jiang: “Yes.â€
Screws and metal plates were placed on the broken bones to keep them in place. Mr. Jiang is left with many residuals from the accident.
The jury found the driver liable for the accident and awarded the victim a $6 million verdict. Paul Dansker, of the law firm Dansker & Aspromonte Associates, explains that there are no standards for how victims are compensated for their injuries and/or losses. It depends on the severity of the injuries and whether the victim is still able to work; how much the victim should be awarded is up to the jury to decide. Due to the fact that the car driven by the driver was rented, the car rental company was responsible for compensating the victim. But four years ago, the insurance company revised their policy; they are no longer responsible for the driver‘s accidents and are only obligated to pay victims a maximum of $25,000. If the defendant does not appeal within a week after the verdict is awarded, Mr. Jiang will get the $6 million. Mr. Jiang is slowly recovering from the accident and is able to return to work, performing light tasks.
